Agreement to Terms

Description of Services

Oculah provides CRM (customer relationship management) services to its clients. To deliver and manage these services, Oculah uses GoHighLevel as its CRM, automation, and communications platform. Through this system, Oculah manages customer data and communications and may contact you by email, phone call, and SMS/text message, where you have provided the appropriate consent.

We may modify, suspend, or discontinue any part of our services at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the services.

User Responsibilities

When using our website or services, you agree to:

• Provide accurate, current, and complete information when you contact us, submit a form, or sign up for services.
• Keep any login credentials or account information confidential and secure.
• Use our website and services only for lawful purposes and in accordance with these Terms.

Unless otherwise stated in writing, fees are non-refundable. You are responsible for any taxes associated with your purchase. If a payment fails or is reversed, we may suspend or terminate the related services. We do not store your full payment card details; payment data is handled by Stripe in accordance with its own terms and privacy practices.

Intellectual Property

All content on www.oculah.com and within our services, including text, graphics, logos, designs, and software, is the property of Oculah or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

The Oculah name and logo are the property of Oculah. Nothing in these Terms grants you any right to use them without our express written consent.

Disclaimers

Our website and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Oculah does not warrant that the website or services will be uninterrupted, secure, error-free, or free of harmful components, or that any results obtained from using the services will be accurate or reliable.

Limitation of Liability

SMS Messaging Terms

Oculah operates a text messaging program through its communications platform. Consent is required before we send you any SMS/text messages, and you may opt in by submitting your mobile number and agreeing to receive messages from us. Consent to receive text messages is not a condition of purchasing any goods or services. By opting in, you agree to the following terms.

Types of messages you will receive. When you opt in, you can expect to receive messages from Oculah such as responses to your inquiries, account and service-related notifications, customer support messages, and, where applicable, promotional messages related to our CRM services.

Opt-out instructions. You can cancel the SMS service at any time. Just text "STOP" to +1 914-486-5708. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Help instructions. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@oculah.com .

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Message and data rates. As always, message and data rates may apply for any messages sent to you from us and to us from you.

Message frequency. You will receive recurring messages; message frequency varies based on your interactions with us. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the laws of the state in which Oculah is principally located, without regard to its conflict of law principles.
